Update on Regulatory Changes within the Individuals with Disabilities Education Act
Thank you to the approximately three thousand homeschoolers who responded to our February 2005 e-lert which advised HSLDA members of the regulatory changes pending with the newly passed IDEA re-authorization.
The process of forming new regulations takes time. The next round of review is scheduled for May and June. However, your comments have highlighted the concerns of homeschoolers.
Recently, Caleb Kershner met with officials from the Office of Special Education and Rehabilitation Services (OSERS) to again express the concerns of homeschoolers over the coming regulation. "We are hopeful that the new child find regulations will be written in such a way as to clearly state that local authorities are not mandated to seek children who are ineligible for government special education services and whose parents do not wish their children to undergo a government evaluation," said Caleb.
Under the current law the regulatory framework is unclear. It is important that the regulators make the common sense clarification that is already supported by the House Education Committee.
