Recognized Compelling Governmental Interests

  • Security of inmates and staff at a penal institution, George v. Sullivan, 896 F. Supp. 895, 898 (W.D. Wisc., 1995); Diaz v. Collins, 872 F. Supp. 353 (E.D. Tex., 1994) (state interests in having inmates cut their hair—such as prison security, identification of inmates, the impact of long hair on industrial safety, and general concerns about hygiene—are compelling governmental interests).
  • Prison order, security, and administrative efficiency, Felix v. Rolan, 833 F.2d 517, 519 (5th Cir. 1987) (“state's legitimate interest in prison security requires an efficient system of identification and administration of prisoners within its custody”); Azeez v. Fairman, 604 F. Supp. 357, 363 (C.D. Ill. 1985) (prison security, discipline and administration are compelling state interests by definition).
  • Protecting health and safety through municipal building codes, City of Solon v. Solon Baptist Temple, 457 N.E.2d 858 (Ohio Ct. App. 1982).
