C Family v. Social Security Administration
SSI benefits withheld because of homeschooling
Filed: November 29, 2004.
Nature of Case: A.C. is entitled to receive Supplemental Security Income (SSI) because he has Asperger's Syndrome, but the Social Security Administration (SSA) has misinterpreted the law to claim that his benefits should be reduced since he is homeschooling, refusing to recognize home-educated students as "students." HSLDA appealed the SSA decision, but the hearing officer ruled against us on August 24, 2005.
Status: HSLDA has appealed to the Social Security Administration's Appellate section. We are awaiting a decision. Ongoing.
