Benefits denied on question of valid enrollment

Filed: May 7, 2004

Nature of Case: HSLDA is assisting a single mother in San Francisco in obtaining government cash aid for her homeschooled 16-year-old son. The Department of Human Services is questioning whether her son is in compliance with the compulsory attendance law since he is enrolled in a private Independent Study Program located in Fresno.

Status: On February 8, 2005, the ALJ handed down a decision in our favor, stating that “San Francisco County improperly proposed to decrease the claimant’s CalWORKs cash aid…on the basis that her son was not regularly attending school.”
